These Terms of Service ("Terms") govern your use of the KerbNab mobile application (the "App"), operated by Billy, an independent sole developer based in Australia ("KerbNab", "we", "us" or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 16 years old to create an account and use the App. By using KerbNab, you confirm that you meet this requirement and that the information you provide is accurate.
2. Your account
You can browse KerbNab without an account, but posting finds, commenting, messaging, and saving items require a free account. You sign in using Sign in with Apple or Sign in with Google. You are responsible for activity that happens under your account and for keeping your sign-in method secure. Let us know promptly if you believe your account has been used without your permission.
3. How KerbNab works
KerbNab is a platform that helps people share and discover free kerbside items, view hard rubbish collection information, and communicate with other local users. KerbNab itself does not own, supply, inspect, collect, deliver or guarantee any item listed in the App. All items are offered and collected directly between users.
4. Your content and licence
You retain ownership of the photos, descriptions, comments, messages and other content you create and post in the App ("Your Content"). By posting Your Content, you grant KerbNab a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and distribute that content solely for the purpose of operating and providing the App and its features (for example, showing your post on the map and feed). This licence ends when you delete the relevant content or your account, except where the content has already been shared with other users (such as messages) or where we must retain it to comply with law.
You are responsible for Your Content, and you confirm that you have the right to post it and that it does not infringe anyone else's rights or break any law.
5. Acceptable use
To keep KerbNab safe and useful for everyone, you agree not to:
- Post items that are illegal, stolen, hazardous, recalled, or prohibited from kerbside disposal.
- Post false, misleading, offensive, or inappropriate content.
- Harass, threaten, abuse, impersonate, or invade the privacy of other users.
- Use the App to spam, scam, or solicit money or goods for sale (KerbNab is for free items).
- Attempt to disrupt, reverse engineer, or gain unauthorised access to the App or its systems.
We provide tools to block and report users and content. We may remove content or suspend or terminate accounts that breach these Terms or our community guidelines.
6. Safety and community interactions
KerbNab connects you with other members of the public. We do not vet users, items, or the safety of any item or meeting place. You interact with other users and collect items at your own risk. Please use common sense — meet and collect in safe, public, legal locations, and follow your local council's rules for kerbside collection. To the extent permitted by law, KerbNab is not responsible for the conduct of any user or the condition, safety, legality or availability of any item.
7. KerbNab Pro subscriptions
KerbNab offers an optional paid auto-renewing subscription, "KerbNab Pro", available as a monthly or an annual plan. Pro unlocks: advanced filters, saved filter combinations, nearby-find alerts, and the ability to post requests to the Looking For board.
- Subscriptions are sold and billed through your Apple App Store account at the price shown in the App at the time of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel your subscription, and turn off auto-renewal, at any time in your Apple App Store account settings. Cancelling stops future renewals; you keep Pro access until the end of the period you've already paid for.
- Refunds are handled by Apple in accordance with the App Store's policies. Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.
Use of the App is also subject to Apple's Licensed Application End User Licence Agreement (apple.com/legal/…/stdeula), which applies in addition to these Terms. We may change Pro features or pricing in the future; any price change will apply only to future billing periods and will be communicated as required by the App Store.
8. Intellectual property
The KerbNab name, logo, design, and the App itself (excluding Your Content) are owned by us and protected by law. We grant you a personal, non-transferable, non-exclusive licence to use the App for its intended purpose. You may not copy, modify, or redistribute the App except as permitted by law.
9. Deleting your account and termination
You can delete your account and associated data at any time from within the App (Profile → Delete account). We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the App. On termination, the licences you granted continue only to the limited extent described in section 4.
10. Disclaimers
The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee that the App will be uninterrupted, error-free, or that listings or information (including collection schedules) will be accurate, complete or current.
11. Limitation of liability
To the maximum extent permitted by law, KerbNab and its operator will not be liable for any indirect, incidental, or consequential loss arising from your use of the App, your interactions with other users, or your collection of any item. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other laws that cannot lawfully be excluded.
12. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Where we are permitted to limit our liability, we do so to the extent allowed by that law. These Terms operate alongside, and do not remove, your rights under the Australian Consumer Law.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above, and significant changes may be communicated within the App. Your continued use of the App after an update means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
